Payment terms

We aim to have websites ready within 2–3 weeks, provided all required information, content, images and feedback are supplied promptly. If you are unable to provide the required materials or feedback within this timeframe, the project may be delayed; however, payment will still become due one month after submitting this form.
This helps ensure projects continue to move forward and do not become unnecessarily delayed or left incomplete.

We aim to provide a high standard of service and will always do our best to create a store that looks professional and supports your business. These Terms of Service, together with your agreed quote or proposal and your completed onboarding form, set out how we will work together. If a specific written quote conflicts with these general terms, the quote will take priority for that point.
We use the information in your onboarding form as a key part of the project brief, so please make sure your answers are complete and accurate. Please provide all additional content and access we request—including product information, written copy, logos, images and lifestyle photography—within seven calendar days of submitting the form wherever possible. If you expect a delay, please tell us promptly. We will not begin the website build until we have received the essential materials, information and account access needed to carry out the work.
The project includes the work described in the agreed quote or proposal. Requests that fall outside that scope, including extra pages, features, substantial redesigns or additional rounds of revisions, may be quoted and charged separately. We will explain any additional charge and obtain your agreement before carrying out the extra work.
Any project timescale is an estimate unless we have agreed a fixed deadline in writing. The schedule depends on receiving complete materials, access, decisions and feedback from you on time. Delays in receiving these items may move the delivery or launch date, and we may pause the project until they are supplied.
We will give you a reasonable opportunity to review the website before launch. You are responsible for checking product information, prices, spelling, links, policies and other supplied content, and for notifying us of any issues within the agreed review period. We will not launch the website until you have approved it, unless we agree otherwise in writing.
Materials you supply remain yours or your licensors’ property, and you give us permission to use them for the project. Until full cleared payment is received, all work created by Digi Creative remains our property. Once payment has been received in full, ownership of the final bespoke website design and original content created by us specifically for your project will transfer to you, subject to any further document reasonably required to record that transfer. This does not include our pre-existing tools, methods or reusable materials, or third-party items such as Shopify, themes, apps, fonts, stock assets and software, which remain subject to their own licences. We can transfer only rights that we own.
You may cancel the project by giving us written notice. If you cancel before work begins, no service fee will be due, although you remain responsible for any non-refundable third-party costs that you approved. Once work has begun, you will be charged a reasonable amount reflecting the work completed, commitments made and losses directly caused by the cancellation, less any costs we can reasonably avoid. The charge will not exceed the agreed project price. Where the project is substantially or fully complete, this may mean that most or all of the project fee is due. We will explain how the amount has been calculated.
Nothing in these terms limits any cancellation or other rights you have by law. If you are contracting as a consumer online, you may have a statutory 14-day cancellation period. If you expressly ask us to begin work during that period and then cancel before the service is complete, you may be required to pay a proportionate amount for the work already carried out.
We provide two months of reasonable post-launch support to help you become familiar with the Shopify platform and to address issues directly caused by our work. This does not include new features, ongoing content entry, substantial design changes or issues caused by third-party services or changes made by someone else. After the included support period, additional work is charged at £45 per hour with a minimum charge of £45 per request. Grouping smaller tasks together will usually provide better value. We will confirm the likely cost before starting paid support work.
You are responsible for ensuring that the content, products, claims, images and other materials you provide are accurate, lawful and do not infringe anyone else’s rights. You are also responsible for the legal and regulatory information required for your store, including appropriate privacy, cookie, shipping, returns and consumer information, unless our quote expressly says that we will provide it.
Shopify, domain providers, payment processors, themes, apps and other third-party services are governed by their own terms, prices and availability. Unless included in our written quote, you are responsible for their fees and accounts. We are not responsible for outages, changes or restrictions imposed by a third-party provider, but we will provide reasonable help where the issue relates to our work.
Any material change to the agreed project or these terms must be confirmed in writing by both parties. By ticking the Terms of Service checkbox and submitting the form, you confirm that you have read and agree to these terms and that you have authority to enter into the agreement. These terms are intended to create a legally binding agreement, but nothing in them removes rights that cannot legally be excluded.
